What To Do Right Now
Follow these steps to protect yourself and your case
Safety First
If anyone is seriously injured, call 911 immediately before doing anything else.
- Check yourself and passengers for injuries
- Call 911 if anyone is hurt — even minor pain
- Do NOT move anyone who may have a spinal injury
- Turn on hazard lights if possible
- Stand away from the road — not between vehicles
- Set up flares or warning triangles if available
- Stay at the scene — never leave
- Always get a police report — even for minor accidents
- This is critical evidence for your case
- Give the officer your account of what happened
- Get the report number before officers leave
- Take photos of ALL vehicles from every angle
- Photograph the entire accident scene
- Capture road conditions, traffic signs, and skid marks
- Photograph any visible injuries
- Save your dashcam footage immediately
- Get photos of all license plates
- Screenshot the location on your phone's map
- Get the other driver's name and phone number
- Get their insurance company and policy number
- Get their driver's license number
- Note the vehicle make, model, color, and plate
- Get contact info for any witnesses
- Do NOT admit fault or say "I'm sorry"
- Do NOT call ANY insurance companies, including your own — you don't have to call right away
- Do NOT sign anything from the other driver's insurance
- Do NOT give a recorded statement to any insurance company
- Do NOT post about the accident on social media
- Do NOT refuse medical treatment at the scene
- See a doctor within 24 hours — even if you feel fine
- Many injuries don't show symptoms immediately
- If you were in a motor vehicle accident, you only have 14 days to see a doctor or you may lose your PIP (Personal Injury Protection) benefits
- Medical records are crucial evidence for your case
- Follow all treatment plans your doctor recommends
